On June 15, 2012, the U.S. Department of Homeland Security (“DHS”) announced its DACA process for certain individuals who came to the United States as children/minors. If granted, individuals may be eligible for work authorization and will be protected from removal from the United States for a period of two years. U.S. Citizenship and Immigration Services (USCIS) has developed a process which allows immediate family members of U.S. citizens to file waivers of inadmissibility for unlawful presence from within the United States. This will make the separation time between U.S. citizens and their family member shorter during the immigrant visa application process. Applicants will still have to leave the country to finish processing their immigrant visa application, but for a much shorter time.
